My wife decided to turn a little too early out of a space in Tesco the other day, unfortunatley it was the end space next to a trolley shelter which had a nice big sharp railing and it gouged a great big slice out of the rear quarter panel. Personally, though it was her fault for turning too sharp, I would have thought surely there should be a guard on the edge of it to prevent such damage (if someone walked/fell onto it there would be an injury) Do you think we have a small case to take up with them? like I said, if you were to walk into it or fall against it, it is quite sharp and you'd really hurt yourself, infact, if a kid ran into it, god knows what would happen because it's head height. I know they'll probably just say "It's your fault" but the damage would be less if there was a plastic or rubber end to it. The scratch which is deep into the metal would probably just be a bad crease. Mike |

There's probably a notice somewhere in the Car Park saying "Cars parked at owners risk", which will absolve them of any blame

I think that sign means nothing, they still have to have some sort of insurance etc especially if you pay for the parking, if not then it could be tough luck Edited by topazman |

So, if that had been the corner of someone's car parked next to you wife's, then it would be the owner of the said car's fault for parking it there?? If your wife had stopped on first contat the damage would not be so bad either. Personally, I don't think you have a leg to stand on blaming Tesco's. ( BTW... no connection to Tesco's ) |

I have to agree with Sporty on this one. In fact if you raise it with tesco they may well charge you for damage done to the trolly shelter. |

I'm not complaining about the fact my wife can't drive! lol (hope she doesn't read this!) but my point is, there should have been protection on that bar. If my kid had walked into it and cut himself due to the sharp edge, would Tesco say he should have watched where he was going? If you damaged your suspension on a pothole that was clearly visible, would the council refuse to pay for the damage because you saw the hole? My point is, on all the other barriers in the trolley parks, there were edge protectors which were soft rubber, on this particular one, there wasn't. I'm not holding Tesco liable for my wifes driving, just the amount of damage done. The barrier was slightly mishaped and had been hit before so Tesco had not repaired it from the last time (also probably my wife lol!) Maybe it's just the fact I'm going to have to fill and spray the damage that it's peed me off! Mike |

If we are talking personal (human) injury then the story would be different, but the circumstances would be taken into account, so, if child was running around playing in a carpark then it could be brought into question whether a carpark is a suitable place for a child to be running around. The barrier is there to protect the trolley shelther and stop people driving into it.... roads are there to be driven on therefore should be of a certain standard to allow driving on them to be possible without causing damage to vehicle is that not why we pay RFL and fuel tax and and and............... OK, it's a fair cop guv, maybe I was being a little optimistic. I'm just glad it wasn't my car, I'm not sure i'd forgive her! She has a Fix Or Repair Daily so I should expect it really! Mike |
