If they refuse to pay out contact the insurance ombudsman. Since you weren't the driver you may be ok, but it's difficult to say. Hopefully they will not require to see a copy of your license as you were not driving.

Get a good solicitor. Don't respond until you get some proper advice. Hope
it works out. Bloody insurers. You do have a case if you genuinly believe that
the details you gave them were correct when you signed up.

I work with insurance companies daily and I would never defend them, however if it was your insurance policy that your wife is covered under then I don't think it will matter that you were not driving. It is a contract of good faith on both sides with them expecting to have all material facts disclosed.

You ought to have checked your licence, ignorance, i.e. assuming your points had expired is no excuse under such circumstances.

That said, as flyingalex says, get a good solicitor and good luck.

I understand exactly what you are saying and ignorance is not an excuse but why would I hide an SP30 that was 4 years old given the fact that it wouldnt have made a difference in the premium anyway.

If I had hidden the fact that I had a drink drving ban or due care and attention etc then I could understand the issue but an SP30.....if they want to get arsey I know they can as the fact remains I havent told them about an offence within 5 years regardless of the nature.

Have they asked to see a copy of your license?

If not then don't worry about it.

WRT insurance companies they can and do use any excuse in the book to get out of making claims.
