Still deciding if I'm ever going to take it back to that dealership!

I have written to the Dealership and BMW advising them of the out of pocket situation and what they are going to do about it.

Your even considering it ??? Still would be interesting to see what treatment you got if you did ..lol .... they might ask you to drive it into a shipping container which was fixed to teh ground and bolted to teh side of the building with another container ontop and at both ends ....lol

Went to the recovery yard this morning.

Managed to get all my tools including my foot pump out of the boot and the industrial strength rubber mats.  Which I'm quite pleased about.

Both Atlases and Glasgow and Edinburgh A-Z's were gone along with my tyre pressure gauge.

Also got my Lightning McQueen tax disc holder back!

Car was covered with finger print dust.

It was a bit weird seeing the beast again but I don't think it hit me till I was driving away from the yard.

No damage that I could see.

Someone will get a bargain if they can live with the fact that it will show up as stolen and recovered on the history.  Still has the service included on it.

Time for another little update

I spoke to the Insurance Company recently and asked them to pursue my costs.  This includes my excess, travel costs down to Derby twice and loss of the "Service Included" which will cost me £195 from Harry Fairbairns. 

I am still looking at being about £700 out of pocket.

Insurance Company rang today to tell me that I should be getting my excess back £150  and that my No Claims Bonus has been restored, but it was protected anyway ????

So we will have to wait and see when I actually get my cheque for £150 and if I get another cheque for the remaining £550.

Will keep you posted.

Insurance Company have e-mailed me to say that they are chasing my costs from the third party insurance company or direct from the offending dealer.

It would have been cheaper for him to fit me a towbar and I would have called it quits at that!

Given your post in Be careful what you say online about a dealer... about how the dealer still has not addressed the fact that you are out of pocket because they managed to let your car get stolen, have they given you a reason?
What do BMW UK say?

Are they both ignoring you or disputing the matter or what?

Oh yes, the dealers response is "our respective insurance companies are both engaged in dialogue in an effort to resolve matters" and "the situation has moved to another platform and that outcome is beyond my remit"

Yip, pretty much.

I called the insurance company last night to ask them where the chuff my excess was as they told me a month ago that "I should get it back", they said they are still awaiting this from the dealers insurance company.  Sounds like to me that the dealers insurance company have admitted that it is their fault but have not yet handed over any £££'s to my insurance company.

When my mum had a claim 9 years ago, she was told something along the lines of that yes the other party have admitted fault and will pay out but it can take several months, getting on for a year before any cash is handed over as rumour has it that insurance companies only ever give cash to other companies at certain times of the year or only annually.

The girl I spoke to last night did confirm that my no claims bonus has been restored but she also said that my premium would increase as their is a higher risk associated with me as my car was stolen. 

It's just so unfair.

Time to step it up a gear . . . I'm sure I mentioned uninsured loss in relation to the claim in a previous post and the necessity for legal advice in relation to any loss.

Sherriff Court & small claims action, the upper limit is now £3000 and the cost is, if memory serves around £75.

The point of the excersice is that when the summons is issued it will almost certainly be in the defendants interest to settle up quickly. It's a heavy handed tactic but very effective. The appearance of the summons itself is usually enough to get some movement.

The trick is knowing who to raise the action against . . . hence the need for a lawyer

Complancency and lethargy on the part of the pursuer are the only things that a defendant (the dealer) has to his strength. It is difficult to maintain momentum in this type of issue, but there comes a point were it is no longer financially viable, spending hours and hours on phone calls and letter writing will start to cost you.

Chin up dude . . . this part of the claim can take months to resolve.

OMG... this is ridiculous! Insurance is such a scam... There just seems to be no point in it whatsoever apart from the fact that it is a legal requirement. There doesn't seem to be any point in claiming... ever... since it's always going to adversely affect your premium...

So you have an accident - and it's not your fault... the insurance company get all their money back... you were already paying them extra for protecting your no-claims bonus... and now they increase your premium due to the made-up reason of there being a higher risk associated with you...

That is nonsense. Are they suggesting that someone who has had their car stolen are more likely to get their next car stolen??? (I would have thought it would be the other way around - i.e. you'd be a lot more careful with the security of your car if you'd already had one stolen)

This is insurance company bullsh*t. Any excuse to charge more. Ridiculous. I'd speak to the manager straight away and tell them you are moving companies. You're bound to get a better deal somewhere else.

Got another phone call last night fromt he Insurance Company to tell me that I will get a cheque for my excess £150 by the end of next week.  Am I right in thinking that this cheque comes from the other insurance company i.e. the dealers insurance compnay?

She did tell me that if I don't get it by the end of next week to get straight on the phone to them again and they will chase it up.

Don't worry I will be arguing the toss severely with them when it comes to renewal time in a few weeks time.  My wife insures her car with them also so I can play that card too.

I'm afraid so mate.

Still not resolved to my satisfaction, after all it has only been about 5.5 months since the car was stolen.  Even the acceleration of a 520d is quicker than this to get moving

OH MY GOD!!

I've just read this whole thread start to finish and i must say its a bloody disgrace.

The last time a salesman was unco-operative and downright rude to me i was about to chin him and im not a violent person.  When customer facing people like that are rude it just beggers belief.

I would say that at least on here, you come over as very calm about the whole thing.

From the outset, i would have been reading the riot act.  Shouting and swearing doesn't get you anywhere quick but jesus, it makes you feel better!

1 - i would have been demanding acting be taken against the unhelpfull bmw staff by the DP

2 - I would have gone straight to the papers about it - local and national

3 - although the 520d was ok-ish i would have demanded 'like-for-like' and not moved from the spot until i got it

4 - Why was the car not repoted as stolen ASAP?! instead of a day and a half later?

And finally, i would be finding out where the head salesman stayed and sh*tting in a bag, setting it on fire on his doorstep and running like the wind!!

I admire your resolve and im really glad you got it all solved more or less though.  Chin up!
