Your even considering it ??? Still would be interesting to see what treatment you got if you did ..lol .... they might ask you to drive it into a shipping container which was fixed to teh ground and bolted to teh side of the building with another container ontop and at both ends ....lol

Do they know you have a new one now???

Still deciding if I'm ever going to take it back to that dealership!

I have written to the Dealership and BMW advising them of the out of pocket situation and what they are going to do about it.

Nah, I've got a big garden to do up and I want to use my dads trailer to go between home and B&Q several hundred times with bits for the garden etc.  Also I have a tree to cut down and then dispose off.

Might be quite good fun to see what the acceleration would be like with my dads caravan behind it.

About to send another letter to BMW and Mr Dealer Principal at Douglas Park outlining my £800 odd losses, made up of insurance costs for temp vehicle, time off work, excess, additional insurance cost for new vehicle, insurance premium rise, travel to Derby to collect the car and loss of service included as I'll need to pay for the first service of the car.

A main dealer wouldn't touch it as it will be flagged as stolen/recovered.  When you buy a car from BMW they give you a certificate to show that it has not been stolen/recovered.

Yeah I wondered if it would be come the property of the other insurance company. The guy at my insurance company, I could tell didn't know the answer to that question.

All I want is my stuff back out of it.

Beemaboy, I have bought another E60 with the insurance cash now.

And if it was given a clean bill of health from the AA or BMW?

Works a little differently here in SA...if they find your car and they have not paid you out yet...you get the car and then claim back off insurance for any repairs...if there is no damage, then you were lucky :(

I had presumed that the insurance company would be compensated by the dealer (as AFAIK its their fault). If so then surely the car is the dealers property now regardless of whether they want it or not?
