Thanks for the update Ian!
I told my neighbour who has 3 cars of that make and uses that garage. He is thinking about trading his car it in for an old mans car, er an E Class Mercedes!

I have got a letter drafted to the Dealer Principal, detailing my uninsured losses. Haven't sent it yet. Need to make sure it is spot on first.

......and another update!
After 10 weeks, I got a phone call last night from CID to tell me that they have found my car.
It has been found in a private residential area (I think in a residents parking bay) in Gilmerton in Edinburgh.
A resident phoned local plod last night to tell them that there has been a car parked here for 10 weeks.
Car has now been recovered to a storage yard where I am hoping to get my personal stuff back out of it.

I don't know.
Just phoned Insurance Company and they say they can mail me the key to go and get my personal stuff out of the car.
It would appear that they hope to get the payout value from the Dealer/Dealers insurance company and then sell the car and keep the cash for the car.
That's like them getting paid twice isn't? So they pay out to me so they are out of pocket, they get cash back so they are even, they then sell the car so they are then well in pocket.

Would you also not prefer to have your old car back, as you said you were battling to find one at such a good deal again?

Wouldn't the car become Stolen-Recovered for insurance purposes? This would/could affect resale value and I wouldn't expect it to be sold via a main dealer?

I had presumed that the insurance company would be compensated by the dealer (as AFAIK its their fault). If so then surely the car is the dealers property now regardless of whether they want it or not?

And if it was given a clean bill of health from the AA or BMW?
Works a little differently here in SA...if they find your car and they have not paid you out yet...you get the car and then claim back off insurance for any repairs...if there is no damage, then you were lucky :(

A main dealer wouldn't touch it as it will be flagged as stolen/recovered. When you buy a car from BMW they give you a certificate to show that it has not been stolen/recovered.
Yeah I wondered if it would be come the property of the other insurance company. The guy at my insurance company, I could tell didn't know the answer to that question.
All I want is my stuff back out of it.
Beemaboy, I have bought another E60 with the insurance cash now.

About to send another letter to BMW and Mr Dealer Principal at Douglas Park outlining my �800 odd losses, made up of insurance costs for temp vehicle, time off work, excess, additional insurance cost for new vehicle, insurance premium rise, travel to Derby to collect the car and loss of service included as I'll need to pay for the first service of the car.

Nah, I've got a big garden to do up and I want to use my dads trailer to go between home and B&Q several hundred times with bits for the garden etc. Also I have a tree to cut down and then dispose off.
Might be quite good fun to see what the acceleration would be like with my dads caravan behind it.
